Welcome to Cup O' Paca Coffee and Teas (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of www.cupopaca.com (the “Site”), including all purchases, subscriptions, and services.
By accessing our Site or placing an order, you agree to be bound by these Terms, our Privacy Policy, and our Refund & Cancellation Policy.
1. Eligibility & Use of the Site
You must be at least 18 years old or the age of majority in your jurisdiction to use this Site.
You agree not to use the Site for any unlawful purpose or in violation of applicable laws or regulations.
2. Products & Services
We sell:
- Freshly roasted coffee products
- Coffee subscriptions
- Print-on-demand merchandise
- Merchandise in our warehouse
Some products are fulfilled by third-party vendors, including:

Temecula Coffee Roasters (coffee roasting & drop-shipping)

Printify (print-on-demand fulfillment)
All products are subject to availability.
3. Pricing & Payments

All prices are listed in U.S. dollars, unless stated otherwise

Payment is processed securely through Shopify Payments or other authorized payment providers
We reserve the right to refuse or cancel any order for any reason, including suspected fraud or pricing errors.
4. Orders & Fulfillment
Once an order is placed, it may be sent immediately to our fulfillment partners for production.
Orders cannot be modified or canceled once fulfillment has begun.
Shipping timelines are estimates and not guaranteed.
5. Subscriptions & Automatic Renewals
Subscription Terms
By purchasing a subscription, you agree that:
- Your subscription will automatically renew at the selected billing interval
- Your payment method will be charged automatically unless canceled
- Subscription pricing and delivery frequency will be disclosed at checkout
Managing or Canceling Subscriptions
You may manage, pause, or cancel your subscription at any time by:
Cancellations must be completed before the next billing date to avoid being charged.
Subscription Refunds
Subscription orders that have entered fulfillment are non-refundable, except as outlined in our Refund & Cancellation Policy.
6. Refunds, Returns & Cancellations
All refunds, replacements, and cancellations are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference.
Due to the nature of our products:

Coffee products are final sale and non-returnable

Print-on-demand items are final sale and non-returnable
Exceptions apply only for damaged, defective, or incorrect items.
7. Shipping & Risk of Loss
Risk of loss and title pass to you upon delivery to the carrier.
We are not responsible for delays caused by carriers, weather, or other circumstances beyond our control.
8. Intellectual Property
All content on the Site—including text, images, logos, graphics, and product designs—is the property of Cup O' Paca Coffee and Teas or its licensors and may not be used without written permission.
9. User Accounts
If you create an account:
- You are responsible for maintaining its confidentiality
- You agree to provide accurate and current information
- We reserve the right to suspend or terminate accounts for misuse or violation of these Terms

Our Site relies on third-party platforms and vendors, including Shopify, Temecula Coffee Roasters, Printify, and payment processors.
We are not responsible for the actions, policies, or services of third-party providers.
11. Disclaimer of Warranties
All products and services are provided “as is” and “as available.”
We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Cup O' Paca Coffee and Teas shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products.
Our total liability shall not exceed the amount paid for the product giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Cup O' Paca Coffee and Teas, its officers, employees, and partners from any claims arising from your violation of these Terms or misuse of the Site.
14. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict-of-law principles.

Automatic Renewal & Subscription Disclosures (State-Specific)
This section applies to all subscription purchases made through Cup O' Paca Coffee and Teas.
1. Clear Disclosure of Automatic Renewal (All States)
By purchasing a subscription, you acknowledge and agree that:

Your subscription will automatically renew at the frequency selected at checkout

Your payment method will be charged automatically for each renewal
- Subscription price, billing frequency, and shipping frequency are clearly disclosed before purchase
- The subscription will continue until you cancel
2. Billing & Pricing Terms (All States)

Subscription charges occur in advance of each billing cycle
- Applicable taxes and shipping fees will be added where required
- Prices may change with prior notice; changes apply to future renewals only
3. Cancellation Methods (Required by CA, NY, CO, VA)
You may cancel your subscription at any time using one of the following methods:
- Logging into your customer account and canceling online

There are no cancellation fees.
Cancellations must be completed before your next billing date to avoid being charged.
4. California Residents (CA ARL – Bus. & Prof. Code §17600)
For California customers:

- You must affirmatively consent to the subscription (e.g., checkbox or purchase action)

We do not impose unreasonable barriers to cancellation.
5. New York Residents (NY GBL §527)
For New York customers:

6. Colorado Residents (CPA & ARL Requirements)
For Colorado customers:

- Cancellation takes effect before the next billing cycle if submitted on time
7. Virginia Residents (VCDPA)
For Virginia customers:
- Subscription terms are disclosed prior to enrollment
- You may cancel at any time through your account or by contacting support
- We do not charge penalties or require unnecessary steps to cancel
8. Illinois & Florida Residents
For residents of Illinois and Florida:
- Automatic renewal terms are disclosed prior to checkout
- You may cancel using the same method used to enroll or an equally simple method
- No additional consent is required beyond your original enrollment
9. Failed Payments & Subscription Suspension
If a recurring payment fails:
- We may retry the payment using Shopify’s billing system
- If payment continues to fail, the subscription may be paused or canceled
You are responsible for keeping payment information current.
10. Changes to Subscription Terms
We may update subscription pricing, frequency, or terms with advance notice by email or account notification.
Changes will not apply retroactively.
